Terms and Condition
AGREEMENT TO TERMS AND CONDITIONS as of 1/6/2020
This is a Legal Agreement between you and Yookte. Please read thoroughly. Should you have any questions with the information pertained in this Legal Agreement please contact us immediately to address at getyookte@yookte.com. Should you not wish to abide to the terms of this agreement, please do not sign up for any of our services as the terms are final and will not be revised to suit individual needs. For clarification purposes, “Membership” will be referred to both clients and member’s. Any distinctions will be referred to separately as client and member, and not “Membership” .
ELIGIBILITY
All clients and member’s need to be single to join. We define single as being Divorced, Widowed, or Single. Please do not apply if you are separated from your spouse even if legally separated, as you do not qualify. We ask that you be at least 24 years of age and you must be at least 18 years of age to be a member or client. Yookte does not knowingly collect, either online or offline, personal information from persons under the age of 18.
REPRESENTATION
You represent and warrant that you have the right, authority, being of sound mind, and capacity to enter into this Agreement and to abide by the entire terms and conditions of this Agreement. If you become a Member or Client, you represent and warrant that you have never been convicted of a felony in the past 10 yrs and that you are not required to register, or have ever been required to register as a sex offender with any government entity and that you have had absolutely no sexual related charges ever brought against you in the court of law, where you have been found guilty.
You agree to always provide true, accurate, current and complete information about yourself, whenever requested by Yookte, not limited to your age, marital status, familial status, residency, employment, salary or criminal history. Should your information change at any time that you are a member or client you agree to update us with those changes by email.
BEHAVIOR
You agree to interact with Yookte, it’s employees, contracted or otherwise, it’s members and clients, affiliates, and partners without violent, harassing, unlawful, defamatory, sexually and/or racially offensive, abusive, threatening, harmful, vulgar, overly aggressive, or obscene behavior. Such behavior not limited to phone, in person, mail, or email communications even if objectionable is a breach of this contract. We reserve the right to immediately terminate your contract given such behavior as stated above.
Should your behavior exhibit violent, harassing, unlawful, defamatory, sexually and/or racially offensive, abusive, threatening, harmful, vulgar, overly aggressive, or obscene behavior to the public, not limited to social media even if objectionable may result in a termination of your membership.
As a user, member or client of our service you agree to take reasonable precautions while in interactions with other users, members, or clients of our service and report any behavior you find suspect or non obligatory of our terms to Yookte, unlawful actions you shall report immediately to local law enforcement.
MEETING
We meet with our clients and members in person or via web cam, when applicable. We will meet in person at a convenient location such as a local cafe.
BACKGROUND CHECK
We reserve the right to conduct a criminal background check. That background check will be run through a third party. We may deny your membership at anytime based on our findings.
TERMINATION
We reserve the right to terminate a member or clients contract at any time we deem appropriate for any reason and not limited to suspected fraudulent, abusive or illegal activity, breach of the Agreement or violation of the Privacy Policy as amended from time to time. You further acknowledge and agree that Yookte may terminate your membership without prior notice and is final.
If Yookte terminates your membership you will be entitled to a refund UNLESS, and ONLY if we have determined that you have not violated or breached this agreement in any way. Here is how your refund would work….You will be refunded from the day of cancellation to the end of your contract term. For example if we cancel your contract on May 15, 202* and your term ends on June 16, 202*. You will be refunded for 33 days.
REFUND AND CANCELLATION
If by 8:00pm EST the next day after joining our services, and you have sent us an email indicating to "Please cancel your contract", that email will be honored and we'll fully refund your contract price, less a background check fee and/or a consultation fee, should either or both apply within 48-72hrs. Processing times by your bank may vary.
If we cancel your plan for any reason that we deem fit, and if you have NOT violated your contract in any way as described in our terms and conditions, you will be refunded on a prorated basis. This does not apply if you have asked for a cancellation.
Background check fee is always non refundable.
CLIENT HOLDS
You have the option to place up to a 2 month hold on your contract, for any reason, at anytime. You can place a hold no more than 2 times, keeping in mind the 2 month hold accumulates. Example, if you place a hold for 1 month, you'll only have 1 month left for your second request.
MATCHES
We make no guarantees as to how many dates you will go on. It is based on your preferences. However we estimate between 1-2 dates per month.
We will extend your contract for 1 month if you do not find someone within your contract period at no cost and only if you have not gone on a minimum 4 dates. If you are on a billed plan and have missed at least one payment or have made at least 1 payment 5 days late, you will not be eligible for an extended contract term.
MEMBERS
Members are free to join, while there is a one time background check that must be paid before being approved to become an active member. The fee is a Non-Refundable $35. Memberships must be reviewed and renewed annually, as relationship status, residence, and needs in a mate may change. No member will be set up on a date with our client until they have personally met with us. If a promotion is in place for waiving any fees, we will honor.
EMAIL COMMUNICATION
When you become a Member or Client, you agree and consent to receive email messages from us. These emails may be transactional, relationship communications or feedback relating to our service, administrative notices, contracts, service announcements or emails containing commercial, promotional or special offers.
BLOG
All content provided on our blog is for informational purposes only. We makes no representations as to the accuracy or completeness of any information on our blog or found by any links on this site. We will not be liable for any errors or omissions in this information nor for the availability of this information. We will not be liable for any losses, injuries, or damages from the display or use of information.
CONTRACT
All contracts will begin on the following Monday of consenting to your contract unless that Monday is a holiday, then we would begin your contract on Tuesday. If you have signed on a Friday after 5pm and anytime Saturday or Sunday, then your contract would automatically commence the following Monday (a week away). If you sign on a Wednesday after 6pm and anytime thereafter during the week, your contract will begin the following Monday (a little over 1 week away). This allows time for us to put together a game plan and run your background check. Instead of setting you up right away with no game plan specific to you.
LIABILITY TO AFFILIATES AND 3RD PARTIES
IN NO EVENT SHALL YOOKTE BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE USE OF SERVICE, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM DOING BUSINESS WITH ANY THIRD PARTY OR AFFILIATE, REFERRED TO OR OTHERWISE KNOWN THROUGH OR BECAUSE OF OUR SERVICE, OUR BUSINESS, OR SITE.
SERVICE AGREEMENT
YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THE PRIVACY POLICY BY CONTINUING FURTHER TO BROWSE ON OUR SITE, INQUIRE, OR BECOME A MEMBER, OR CLIENT.
